1. Introduction
Welcome to EquitableCommonSpark ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht rental services and website located at equitablecommonspark.sbs (the "Service") managed by EquitableCommonSpark.
By confirming a booking or using our Service, you consent to these Terms. If you do not agree with any part of the terms, you should not use the Service.
2. Service Overview
At EquitableCommonSpark, we offer a range of luxury yacht chartering services which include, but are not limited to:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Private festivities
- Extended charters
Our services are offered subject to availability and weather conditions. We have the authority to change or cease services without prior notice.
3. Booking and Reservations
3.1 Booking Process
To arrange a booking, please ensure that you:
- Are 18 years of age or older
- Provide truthful and comprehensive details
- Make a deposit payment as indicated in your booking confirmation
- Accept the Terms & Conditions
3.2 Confirmation
A booking becomes official only when payment is completed and when we send you a written confirmation. We can decline service to any individual at our own discretion.
3.3 Availability
Charters depend on the availability of vessels and favorable weather conditions. We will attempt to accommodate your preferred scheduling whenever feasible.
4. Payment Terms
4.1 Pricing
All quoted rates are in € and incorporate all relevant taxes unless stated otherwise. Pricing is subject to change without any announcement.
4.2 Payment Schedule
- Deposit: 50% of the overall charter cost required at the time of reservation
- Remaining Balance: To be paid 48 hours prior to the departure of the charter
- Supplementary charges (if applicable): To be settled following the conclusion of the charter
4.3 Payment Methods
We take payments through major credit cards, electronic transfers, and certified checks. Payment processing utilizes encrypted and secure technology.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- More than 72 hours prior to departure: Full reimbursement minus transaction fees
- 24-72 hours before departure: 50% of the payment is refunded
- Less than 24 hours to departure: No refund will be provided
5.2 Weather Cancellations
In case our captain concludes that weather conditions are too hazardous, we will propose to:
- Reschedule your booking to another open date at no added cost
- Issue a complete refund when rescheduling is unattainable
5.3 Mechanical Complications
If there is a mechanical issue with the assigned vessel, we will try to arrange a suitable replacement. If no substitute is available, we will issue a full refund.
6. Safety and Conduct
6.1 Safety Regulations
All guests must:
- Heed all instructions given by the crew
- Utilize safety gear when requested
- Disclose any medical conditions that might impinge on their safety
- Remain within designated zones on the boat
6.2 Prohibited Objects
It is prohibited to bring onboard:
- Glassware
- Illegal materials
- Firearms or other weaponry
- Pets (unless previously agreed upon)
6.3 Behavior
Travelers must behave respectfully. We hold the right to terminate a charter without a refund if a passenger’s conduct is deemed a safety hazard or if it spoils the experience for others.
7. Liability and Insurance
7.1 Our Responsibility
Our accountability is restricted to the payment you made for the charter. We are not liable for:
- Injuries sustained due to a passenger's carelessness
- Theft or loss of personal possessions
- Indirect, consequential, or exemplary damages
- Delays induced by weather or situations beyond our power
7.2 Insurance Coverage
Our company maintains inclusive marine insurance for our boats and operations. Clients are accountable for obtaining their personal travel and property insurance.
7.3 Risk Consideration
When you engage in our chartering services, you recognize the inherent risks involved in marine activities and accept responsibility for your personal safety and well-being.
8. Modifications and Itinerary Changes
We hold the authority to alter itineraries, pathways, or timetables owing to weather conditions, safety concerns, or operational necessities. We will strive to ensure a comparable alternative experience is provided.
9. Force Majeure
We will not be held accountable for hold-ups, cancellations, or service changes brought about by forces beyond our control, which can include, but not limited to:
- Extreme weather conditions
- Natural catastrophes
- Governing laws
- Port closures
- Technical malfunctions
10. Privacy and Data Protection
We manage your private data in line with our Privacy Policy. By utilizing our services, you give your consent to our use and collecting of your information as per the Privacy Policy.
11. Intellectual Property
The content on our website, which includes text, visuals, logos, and photographs, is the property of EquitableCommonSpark and is secured by copyright and trademark regulations. Unauthorized copying, distribution, or creation of derivative works is prohibited without our written consent.
12. Governing Law
The applicable laws of Monaco govern these Terms. Any disputes will be resolved in the courts of Monaco, Monaco.
13. Changes to Terms
We retain the right to adjust these Terms as necessary. Updated terms will be published on our website with the new revision date. Using our services after changes means agreeing to the new terms.
